In no circumstances can the Tenant stay in the property or camp around the property after the expiration of the rental period, without the express permission of the Owner. No modifications can be made to this Contract without the express agreement of both parties. The Owner reserve the right to cancel the rental contract anytime in case of disrespectful behaviour against the hostel rules, the Owner or other Tenants. For your own safety, the hostel is occasionnally under video surveillance.
The reservation is confirmed on receipt by the owner of a booking contract and the complete payment of the rental price. The tenant must inform the owner in the event that he or she will arrive late, after 5pm. It is an automatically and independante check in.
In order to cover any possible breakages or damage to the property or the equipment, you will be asked to leave a damage deposit when you arrive. It will be returned to you on your departure day minus any reductions in the case of damage or breakages. If the cost of repairing damage or breakages is higher than the sum of the deposit, the tenant agrees to pay the difference. The damage deposit can in no way be considered as part of the rental price for the property.
The tenant has the right to occupy the house in a peaceful and orderly way. On departure, the tenant agrees to leave the property in the same state of cleanliness as he or she found it on arrival. All fixtures, fittings and furniture on the inventory must be left in the same place in which the tenant found them on arrival. Any repairs to fittings resulting from negligence on the part of the tenant will be paid for by the tenant. In no case can the tenant sub-let the property, even for free. Doing so will render the rental contract null and void. The property is rented exclusively for holiday purposes and must not be used for the exercise of any professional activity. It is forbidden to pitch tents or park caravans on the property without the express permission of the owner. The owner will ensure that the property is made available in a condition that corresponds to its description. Check out time is between 8am-10am in the morning on the departure day.
If the tenant has to leave earlier in the morning (f.e.catching a flight, train or others) in this case check out is the day before between 8am-12am. All extras will be payed at this time and the deposit will be returned.
Internal Hostel Rules
1. Guest Behavior
The comfort, safety and security of our guests is of paramount importance to us. Any guest(s) who, in the opinion of our staff, compromise the comfort, safety or security of other guests, staff or local residents will be requested to leave the hostel premises and will not be offered a refund. Guests are expected to respect other guests, staff, local residents and property.
2. No Smoking
There is a smoking area with ash trays located outside for guests who wish to smoke. Smoking is not permitted anywhere else in the building. Any guest found smoking inside the building will be asked to leave the premises immediately and will not be offered a refund.
3. No Drugs
Drug use is illegal in France. Any guest found using drugs within the building will be asked to leave the premises immediately and will not be offered a refund.
4. Alcohol Consumption
Alcohol consumption is only allowed for guests over the age of 18. Any guest abuse alcohol consumption in the hostel building with a following displaying rowdy behavior will be asked to leave the premises and will not be offered a refund.
5. Noise Curfew
Surf Hostel Biarritz has a noise curfew in place from 10pm until 8am. This includes the outdoor spaces as well. Any guests not adhering to this curfew will be asked to leave the premises and will not be offered a refund.
6. Personal Belongings
It is the guest’s responsibility to ensure that their personal belongings are secure at all times, and Surf Hostels Biarritz accept no liability for the loss, theft or damage to guests’ property, however sustained or caused. We strongly recommend you bring a padlock to use with your luggage & backpack.
7. Damage to Surf Hostel Biarritz Property
Guests will be expected to reimburse Surf Hostel Biarritz for any damage caused by inappropriate behavior during their stay.
The number of tenants cannot exceed the number of tenants written on the booking form sent to the owner. However, in exceptional circumstances and with the express agreement of the owner, it is possible to waive this rule. In such cases, the owner can ask for a higher than usual rate, which would be noted in the rental contract.
If the owner notes any damages, a percentage of the damage deposit equal to the cost of covering any repairs will be withheld by mutual agreement between the owner and tenant. If it is not possible to reach an amicable agreement, an assessment of the damage will be carried out by an independent expert or organisation, chosen by the owner during the inventory at the end of the stay. In such cases, the remainder of the damage deposit will be returned to the tenant within two weeks.
The presence of animals in the house is forbidden. Any tenants not respecting this rule will render their rental contract null and void.
To cancel a reservation, the Tenant must notify the Owner by email prior to the arrival date noted in the booking:
- Any cancellation will result in the Owner retaining a deposit paid of 30% included administration cost.
- If cancellation occurs less than 7 days before entering the premises, the entire stay will be due.
- In high season (July/August) cancellations made less than 14 days prior to the arrival date will incur a 100% charge.
Transport delays, transport cancellations or missed transport (flights, trains, Uber etc) remain the responsibility of the Tenant and do not quality as sufficient grounds for a refund from the Owner.If the tenant does not arrive on the agreed day and subsequently does not contact the Owner within 24 hours, the contract is considered null and void. In such cases the Owner will keep any payment. The Owner will also be free to rent the property to other tenants. In cases where the Owner cancels a rental agreement (outside of ‘acts of god’ that render the property uninhabitable), the Owner will offer the Tenant a suitable alternative accommodate or if not this is not possible, the Tenant will recieve a full refund of all payments made for the booking.
Tenants who leave the property before the end of the agreed rental period will nevertheless pay the cost of the full period unless the owner is deemed responsible for the early departure. In such cases, an inventory will be carried out in the normal way and all or part of the damage deposit will be returned as normal.
The owner takes no responsabilities for thieved, lost or damage of personal items from the tenants.
